I remarked to friends on our way to lunch yesterday that this is just a further expansion of the warrantless wiretaps and Patriot Act type of law enforcement that became acceptable under Bush. The GOP didn't care then. Why care now?

I haven't read everything out there, but I don't think the GOP is expressing outrage at this, I think people are just pointing out the blatent hypocrisy of Obama and the media.

In all seriousness I don't see how this would be illegal, but SCOTUS would have to take it on to throw it out. And they've already decided that the police can use tracking monitors on people/cars without a warrant as they could already trail someone without a warrant. This is of a similar nature. This isn't really gonna help anybody do anything though as dumb criminals will eventually catch on to what a smart criminal already does, use a prepaid cellphone from walmart and throw it out.

As far as law enforcement goes, federal law is basically a minimum standard- states can write more restrictive legislation, and PA does.

we are one of the most heavily restricted when it comes to wiretapping rules: to the point where it is VERY rare for us to seek a warrant to do so.

any new laws would likely be superceded by ones already on the books here in PA- so SCORCHO is safe to carry on his subversion and small-bidniz efforts, at least, up here.
