Sounds to me like he's got pride issues. If the dog says they gotta search the car, get the freak out of your car. If they're lying, they're lying and you have to deal. It's life. This guy's a trouble maker. Take a freaking shower.

haven't watched this yet, but i've learned that if a cop or someone with similar authority asks you to do something, just do it. if they are in the wrong file a complaint and it will get dealt with. most departments don't like bad publicity and will take care of the problem.

cops jobs are hard enough without some yokle defying them.

Dude, if a cop tells you the dog is detecting something, that's probable cause. Is he a pastor or is he the dog whisperer? Sure the cop could have been lying but there's nothing you can do but comply. I think this guy wanted a beating.

The Supreme Court has approved routine warrant-less search and/or seizures, for example "where there is probable cause to believe that a criminal offense has been or is being committed"...

If they said a dog alerted them......that gives them probable cause.....they do not have to show you what the dog did.....asking you to remove yourself from your vehicle is reasonable........excessive force is about the only thing he can hang his hat on.........and that might not even hold up.

Bottom line....instead of trying to invoke your barnes & noble, book-reading club interpretation of the law........just be compliant & do what they friggin' ask you to do.......then if they screw up......file a complaint.

Southern Arizona has had a bad history of corrupt Border Patrol.

I would NEVER let a cop search my vehicle if they asked. It's not their place to do so unless they have probable cause. In this instance when they pulled the dog, you have to let them search.

BP enjoyed the beat down on this guy.

My question: What did the dog smell then if there wasn't any drugs or humans? Does the guy have a point? Are these dogs infallible? Or did the dog not detect anything and BP was going to prove a point?

So I did some reading on this and apparently the 4th amendment is treated a little differently on the border. Any law person can chime in here on why that is and what it means.

most likely the dog didnt smell anything they were just so ticked with this guy for not getting out when they told him to do so...


my big thing is if you knew you were clean why do you have such a problem with them searching the car? what do you have to hide if there is nothing in the car in the first place... thats kinda fishy

Its the principle of the thing...its like an RA going through my stuff when I lived on campus. Yeah, the rules give RAs the right to search your room and I didn't have anything to hide, but if I walked in on one looking through my stuff I'd still be ticked.

not the same situation...

it would rather be like an RA asking to search your room because they heard stuff about you, you have nothing to hide and still dont let them do it... that just makes the whole thing a whole lot more suspicious from the RA's viewpoint in all honesty, same deal with saying it to a cop or BP, refusing just tells them you have something to hide

Looks like United States vs. Martinez-Fuerte gives the BP exclusively the right to do this where as any other agency could not due to the 4th amendment. The internet doesn't lie.
