NEWARK, Del. -- The University of Delaware's decision to eliminate varsity men's cross country and track and field is being investigated by the U.S. Department of Education.

The university announced the decision in January, saying it was trying to comply with Title IX gender-equity requirements when it dropped the teams. Team members filed a gender discrimination complaint with the Education Department.

School spokesman John Brennan says Delaware stands by its decision.

The school said late last month it is "complying fully with a request" for information regarding its intercollegiate athletics program. Delaware says the decision is designed to "provide equitable and substantially proportionate participation opportunities for U.D. men and women."

But in cutting the men’s varsity track team, Delaware took the practice a step further. The university did not make the argument that it needed to cut the team to immediately comply with the law — after all, it plans to add a women’s golf team in the fall. Instead, officials say they are ending the track program, which has its 100th anniversary this year, out of concern that they could not remain compliant in the future.

Now, members of the men’s track team have taken an unusual step of their own: they have filed a complaint with the federal Office for Civil Rights, which oversees Title IX, alleging that Delaware is discriminating against its male athletes. The office decided to look into the complaint, and last week, the university agreed to enter into mediation with the track team to try to resolve the issue.

Yep. You are correct; I am "underwater" (and 14 is a quick one!). It is getting a fair amount of attention locally (in DE, that is), but even more nationally.
